Premises Liability Cases

Their job was to protect you from accidental injury.  Our job is to get you what you deserve.

Property owners, store owners, and the government have a duty to maintain safe premises for guests and patrons.  If you suffer an injury because the property owner failed to maintain a safe and hazard-free environment, you may have cause to sue.  These types of claims are called premises liability claims, and you may be entitled to compensation if you were involved in any of the following:

  • Slip and fall
  • Hazardous conditions
  • Broken steps
  • Dangerous electrical wiring
  • Elevator/escalator-related injuries
  • Snow and ice cases
  • Railroad crossing injuries
  • Public transportation accidents
  • Poorly maintained sidewalks
  • Potholes
  • Inadequate security

The Law Offices of Jay S. Weiss, P.C. investigates each incident that caused injury and determines whether there are grounds for a lawsuit.  Our attorneys then immediately start bringing a case for injured clients.  We waste no time in an effort to save you the expense of case fees and to more quickly get you started on the path to regaining financial stability.

Slip and fall injuries

Property owners' duty of care extends to injuries sustained during a slip, trip, and fall accident.  Not all falls qualify as premises liability claims—the property owner must be proven negligent.  The owner is only negligent when he or she knew about or should have known about the property's dangerous condition and failed to warn guests or patrons of the hazard, if it is not openly obvious.

For example, if you are in a grocery store and slip and fall on a product that had been spilled earlier in the day and not been cleaned up or identified with a "wet floor" sign, you may have a case.  Or if you trip and fall on the icy steps or broken pavement leading up to a friend's apartment, you may be able to sue for damages.   Contact our law firm to discuss your injury today.
